The Delaware Chancery Court, with over 200 years of precedent on its books, is still a top choice despite competition from other states. Specialized business courts draw in sophisticated litigants involved in complex business disputes who are looking for judges with time to unravel those complexities. States are looking to provide opportunities for such litigants to resolve their disputes within their courts.
The Texas Business Court has not reached anywhere near the number of cases filed in Deleware Chancery Court, but the Texas Business Court is still young, having only been in operation since September 2024. Despite any standard growing pains, a group of Texas Business Court judges on a panel at the Institute for Energy Law's 24th Annual Energy Litigation conference hosted in Houston this past November indicated that the new Texas Business Court has exceeded expectations, with nearly 200 cases filed, including 100 in Houston. Recently, the Texas Business Court hosted its first jury trial as well.
Other states' business courts are in the running as well. This includes North Carolina's Business Court, which has been in operation since 1996, and New York's Commercial Division, which was established in 1995.
Only time will tell where business litigants will ultimately place their bets, but for now, the Delaware Chancery Court remains on top as the most well-established court for business disputes.
